1. Scope

This Privacy Policy (this “Policy”) explains how Quantified Communications, Inc. and its subsidiaries and affiliates (“Quantified,” “we,” “us,” or “our”) collect, use, and share information of individuals who use our website, quantified.ai, or another site that links to this Policy (the “Site”).

We may also collect your mailing and billing information when you place an order with us.

When you access or use our Site, we (and other entities) automatically collect information relating to your interactions with us and our Site, including the type of browser you use, device information, access times, pages viewed, files read, search terms, IP address, information about your activity within the Site, information about pages you visited before navigating to our Site, device type, and other information we collect through the use of cookies, web beacons (tracking pixels), and similar technologies. We may also obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms, and other third-party providers, and combine it with information we already hold. For example, this may include business-contact and firmographic information and website-engagement signals from data-enrichment, sales-intelligence, and visitor-identification providers, which help us understand which organizations and business contacts are engaging with us.

4. How We Use Personal Data

Quantified may use information for any lawful purpose, including for the following purposes:

  • to fulfill your orders or perform our contract with you;
  • to track use of our Site, verify accounts and activities, investigate suspicious activity, enforce our Terms of Use and related policies, or otherwise maintain the security of our Site;

We may use information that has been deidentified or aggregated without limitation.

5. How We Share and Disclose Information

We may share or disclose information about you to other parties, including the following:

  • With vendors, consultants, and other service providers who need access to carry out work on our behalf, such as payment processors, data hosting services, and email providers, or with our legal or business advisors;
  • With any affiliates or joint venture partners;
  • With advertising, analytics, and marketing partners that help us deliver and measure marketing;
  • With sponsors or business partners who co-sponsor events, including to allow them to send communications that may interest you, as permitted by law;

  • In response to a subpoena, court order, governmental inquiry, or other legal process or where we believe disclosure is required by applicable law or legal process;
  • To protect the rights, property, and safety of Quantified or others, or to enforce our agreements and policies; or
  • With your consent or as otherwise disclosed at the time of data collection or sharing.

We may share information that has been deidentified or aggregated without limitation.

The Site may contain links to other websites, applications, or online services operated by third-party entities that are not under our control. This Policy does not cover the practices of those entities; their own privacy policies and terms will apply. You should review the privacy policies of other websites or apps that you use to learn about their data practices.

The Site also includes integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share personal information or you otherwise interact with these features on the Site, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public.

Your interactions with third-party companies and your use of their features are governed by the privacy policies of the companies that provide those features. We encourage you to carefully read the privacy policies of any accounts you create and use.

7. Cookies and Similar Technologies

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

You may visit the DAA Webchoices tool at www.aboutads.info/choices to learn more about this type of advertising and how to opt out of this advertising on websites by companies participating in the DAA self-regulatory program. You can also exercise choices regarding interest-based advertising on your mobile device by downloading the appropriate version of the DAA’s AppChoices tool at https://youradchoices.com/appchoices.

If you delete your cookies or use a different browser or mobile device, you may need to renew your opt-out choices exercised through the DAA Webchoices tool. Note that electing to opt out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests.

We may also work with third parties that collect data about your use of the Site and other sites or apps over time for non-advertising purposes, including by using cookies and similar technologies to recognize your browser, understand how and when you use our Site, analyze trends, and operate and improve our Site. We use Google Analytics and other third-party services to improve the performance of the Site and for analytics and marketing purposes. For more information about how Google Analytics collects and uses data when you use our Site, visit www.google.com/policies/privacy/partners, and to opt out of Google Analytics, visit tools.google.com/dlpage/gaoptout.

Additionally, we use a consent management tool where you can make choices about the cookies used on our Site. For additional details on the categories of cookies we use, the third parties involved, and how to manage or withdraw your consent (including via the cookie settings control on our Site), please review our Cookie Policy. Your browser may also offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, our Site may not function as intended.

8. International Privacy Rights

This section applies to individuals who access our Site from the European Economic Area (“EEA”), Switzerland, or the United Kingdom (“UK”).

Depending on the activity, we process personal information under the following legal bases: performance of a contract with you; unless overridden by your data protection rights, for our legitimate interests (such as operating, securing, and improving our Site, for customer service, to personalize content and recommendations, for product development, or for marketing our products and services); compliance with a legal obligation; or your consent (which you may withdraw at any time). Where we rely on consent, withdrawing it will not affect the lawfulness of processing before withdrawal.

If you are located in the EEA, the UK, or Switzerland, you may have the right:

  • To request access to the personal data we hold about you;
  • To request that we rectify inaccurate personal data about you;
  • To request that we erase personal data about you;
  • To request that we restrict the processing of personal data about you, under certain conditions;
  • To request that we transfer personal data about you to another, or directly to you, in a commonly used, machine readable format;
  • Where we previously obtained your consent to process personal data, to withdraw consent to processing such personal data; and
  • To make a complaint to us if you believe that there has been an infringement of these rights.

To exercise these rights, please contact us using the information provided in the “Contact Us” section of this Policy. Please be aware that we may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so.

You also have the right to lodge a complaint with your local supervisory authority. To exercise these rights, contact us as described in “Contact Us.”

Quantified is based in the United States. Please be aware that personal data we collect may be transferred and maintained on servers or databases located outside your country or other jurisdiction, where data protection laws may not be as protective as those in your location. Where required, we use appropriate safeguards for international transfers, such as the European Commission’s Standard Contractual Clauses.

9. Data Retention

We retain information in identifiable form for as long as reasonably necessary for the purposes for which it was collected, including to provide our Site, pursue our legitimate business interests, comply with legal obligations, resolve disputes, and enforce our agreements. Once the retention period expires and if not otherwise required to retain information by law, we may retain information in deidentified or aggregated form where it can no longer reasonably be used to identify you.

10. Security

Quantified takes organizational, technical, and physical measures designed to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no method of storage or transmission is 100% secure.
